A union representative came to my home trying to recruit me. I found out that my employer gave them a list of all employee addresses and phone numbers. Is this legal?
Steve Duggan replies:
Yes, it is. Under the National Labor Relations Act, the NLRB has interpreted the law to require employers to release the home addresses of employees so that the union can communicate with them for legitimate union purposes. Your employer likely didn’t have any choice. The Board has interpreted this as a reasonable intrusion on privacy, especially since home addresses of people are rarely considered “secret” information in today’s world.
